Johnny Marr + The Healers Sweepstakes
ELIGIBILITY. Open to legal U.S. residents within the 50 United States, 18 years of age or older, except residents of Rhode Island. Not open to employees or immediate family members of employees of Sponsors, their affiliates, or advertising or promotion agencies. Any entrant who has won a prize from ARTISTdirect Inc. since September 6, 2002 will not be considered an eligible entrant.
NO PURCHASE NECESSARY. To enter sweepstakes, go to http://info.artistdirect.com/mk/get/CONTEST_9 between 2:00 p.m. Pacific Time on December 9, 2002 and 2:00 p.m. Pacific Time on January 10, 2003 and complete the Johnny Marr + The Healers Sweepstakes on-line entry form. Alternatively, participants may enter by sending a 3 ˝ “ x 5 ˝ “ card with your name, address, phone number, and age to: Johnny Marr + The Healers Sweepstakes, c/o ARTISTdirect, Inc., 5670 Wilshire Blvd., Suite 200, Los Angeles, CA 90036. Mailed entries must be postmarked by January 10, 2003 and received by 5:00 p.m. Pacific Time no later than January 16, 2003. Incomplete and/or duplicate entries will be void. Sponsors not responsible for lost, late, misdirected, postage due, or unintelligible entries, or for inaccurate entry information, whether caused by participant or by any of the equipment or programming associated with or utilized in this sweepstakes, or by any technical or human error that may occur in the processing of entries. Mechanically reproduced or automated entries are not permitted and will be deemed void. Limit one entry per person per household.
PRIZE. The following prize will be awarded: One (1) Grand Prize consisting of: two (2) tickets to each of two concert events performed by the musical group Johnny Marr + The Healers at: (1) the ARTISTdirect, Inc. studio in Los Angeles, California on February 2, 2003, and (2) The Troubadour in West Hollywood, California on February 3, 2003 (the “Concerts”); round trip economy class airfare for two (2) from the major airport nearest winner’s home address to Los Angeles, California departing February 1, 2002 and returning February 4, 2002; three (3) nights standard double occupancy hotel accommodations for the nights of February 1, February 2, and February 3, 2002; $200.00 spending cash; ground transportation to and from the airport in Los Angeles. The total retail value of the Grand Prize is approximately $2,000. Winner is responsible for paying all costs and expenses related to the Grand Prize that are not specifically mentioned in these Official Rules, including but not limited to taxes, transfers, additional transportation, meals, gratuities, and other expenses incurred by accepting the Grand Prize. Travel times, airline, hotel, and exact location of seats at the Concerts will in the sole discretion of Sponsors.
PRIZE DRAWING. The Grand Prize will be awarded at a random drawing held on or about January 10, 2003. Winner will be notified by telephone or e-mail within twenty-four (24) hours of the drawing. Winner will be required to sign an Affidavit of Eligibility and Liability/Publicity Release. Winner’s guest will also be required to sign and return a Liability/Publicity Release prior to participation in prize activities. Winner’s guest shall be 18 years of age or older. If the Grand Prize is not claimed within three (3) business days of notification, or if winner does not meet qualification criteria, an alternate Winner will be selected. Sponsors shall not be liable for: (1) failed, returned or misdirected notifications based on inaccurate information provided by the winner on the sweepstakes entry form; or (2) entries, and responses to winner notifications which are lost, late, incomplete, illegible, unintelligible, misdirected, damaged or otherwise not received by the intended recipient in whole or in part or for computer or technical error of any kind.
ODDS OF WINNING. Odds of winning depend on number of entries received.
MISCELLANEOUS. By participating, participants agree to be bound by these Rules. No transfer, assignment, cash redemption or substitution of Grand Prize is permitted except by Sponsors due to prize availability and then with a prize of equal or greater value. By accepting the Grand Prize, Winner agrees that Sponsors, their respective directors, officers, agents, employees, representatives, affiliates, and advertising and promotion agencies will have no liability and will be held harmless by Winner for any liability, loss, injury or damage to property or to person, including death, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the Prize or participation in this sweepstakes, even if caused or contributed to by the negligence of Sponsors, their affiliates, or advertising or promotion agencies. Participants agree that the decisions of Sponsors related to this sweepstakes and all drawings are final. By participating in this sweepstakes, Winner consents to the use of his or her name and/or likeness for promotional purposes without additional compensation, except where prohibited by law.
ADDITIONAL TERMS. Sponsors reserve the right, in their sole discretion, to modify, terminate, or suspend this sweepstakes should viruses, bugs, unauthorized human intervention or other causes beyond Sponsors’ control corrupt or impair the administration, security or fairness of the sweepstakes. Sponsors are not responsible for any human error that may occur in the processing of the entries, nor are they responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, whether caused by the sender or any of the equipment or programming associated with or utilized in this sweepstakes. Sponsors reserve the right, in their sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the sweepstakes or web site; to be acting in violation of these Rules; or to be acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed or similar entry methods will void all such entries submitted by such methods. In the event of a dispute as to entries submitted by multiple users having the same e-mail account, the authorized subscriber of the e-mail account used to enter the sweepstakes at the actual time of entry will be deemed to be the participant and must comply with these Rules. The authorized account subscriber is deemed to be the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning e-mail addresses for the domains associated with the submitted e-mail addresses.
