Rihanna Being Sued Over "S&M" Video

Reuters reports that famed fashion photographer David LaChapelle is suing Rihanna over her sexual and controversial (and banned in some countries) "S&M" video. He claims that the pop diva directly derived the video from photos that he took. LaChapelle, who has shot for GQ and Vanity Fair, among countless other rags, says the video is substantially similar to his photographic works.
In the suit, LaChapelle said Rihanna had appropriated eight of his images into the video, such as a shot where she is shown in profile against a blue background with a piece of candy on her tongue. LaChapelle said Rihanna's video copied the "composition, total concept, feel, tone, mood, theme, colors, props, settings, decors, wardrobe and lighting" of his work. Those are some rather large charges. Let's see how this one plays out in the courts.
LaChapelle is seeking unspecified damages.
This is a tricky, tricky case, as it's hard to say she stole from a different medium. Or at least I would think that.
What do you think of "S&M?" Do you like the video? Have you seen LaChapelle's work? Do you think he has a case or is he unfairly targeting Ri Ri?
